These Terms apply to the use of the AndHire website and to business services provided by AndHire GmbH, unless a separate written agreement applies.
These Terms of Service apply to the use of the AndHire website and to business services provided by AndHire GmbH, unless a separate written agreement applies.
AndHire provides recruiting, talent sourcing and hiring support for ecommerce and growth-related roles. Our services may include role briefing, candidate sourcing, candidate screening, interview coordination, candidate shortlists, recruiting process support, talent market feedback, hiring advisory, cross-border recruiting support and AI-assisted candidate profile structuring. The exact scope of work is agreed separately with each client.
Our services are intended for business clients within the meaning of Section 14 German Civil Code (BGB). We do not offer consumer recruiting services through this website.
We aim to provide relevant and carefully reviewed candidates. However, we do not guarantee that a client will hire a candidate, that a candidate will accept an offer, or that a specific hiring result will be achieved. Final hiring decisions are made by the client.
Clients are responsible for providing accurate role information, salary ranges, job requirements, decision timelines and feedback. Clients are also responsible for complying with applicable employment, immigration, tax and labor laws when hiring or contracting with candidates.
Candidate profiles, CVs, summaries and interview notes are confidential. Clients may use this information only for the specific hiring process for which the candidate was introduced. Clients may not share candidate information with third parties without prior written permission from AndHire or the candidate.
If AndHire introduces a candidate to a client, the client may not hire, contract with, or refer that candidate outside the agreed process in order to avoid fees. This applies for [12 months] after the introduction, unless agreed otherwise in writing.
Fees are agreed individually with each client. Possible fee models may include a success fee, a retainer plus success fee, a project fee, or a monthly recruiting support fee. Unless agreed otherwise, fees become payable when a candidate signs an employment agreement, contractor agreement or other commercial engagement with the client. All fees are subject to statutory VAT where applicable.
If agreed in writing, AndHire may provide a replacement search if a placed candidate leaves within a defined guarantee period. Example: replacement period 90 days; condition: the candidate leaves or is terminated during the agreed period; scope: one replacement search for the same role profile; exclusion: no replacement applies if the role materially changes, if the client causes the termination without a performance reason, or if payment is overdue.
AndHire may work with selected sourcing and recruiting partners to identify candidates. AndHire remains responsible for managing the client relationship and presenting candidates to the client.
AndHire may use AI-assisted tools to structure role briefs, candidate profiles, interview notes and candidate comparisons. AI is used to improve speed and consistency. Final review and recommendations remain human-led.
Both parties agree to keep confidential business, candidate and process information confidential. This includes candidate profiles, client hiring plans, pricing, internal documents and non-public commercial information.
AndHire processes personal data in accordance with its Privacy Policy and applicable data protection law. Where required, the parties will enter into additional data protection agreements under Art. 28 GDPR.
AndHire is liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence, AndHire is liable only for the breach of a material contractual obligation (an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the client regularly relies), and in that case liability is limited to the foreseeable, typical damage. Any further liability for slight negligence is excluded. To the extent legally permitted, AndHire is not liable for indirect damages, lost profits, lost revenue or business interruption. Mandatory statutory liability that cannot be excluded remains unaffected.
